Copyright is the process which describes the process of giving legal rights to creators of artistic works. All these works, from novels, plays, newspapers to drawings, sculptures, advertisements, etc., are called artistic works. Even music, technical drawing and computer programs can receive copyrights, as they are part of the artistic works too.<\/p>\n

The importance of copyright is given by the fact that artists become known and their work is recognized, also they can receive important sums of money for their creations. Copyright protects any artist and makes sure that anyone who violates their artistic work’s rights is punished by the law. This way creators can distribute their works freely and without worrying, contributing to the culture, knowledge and entertainment everywhere on earth.<\/p>\n

If somebody wants to sell and promote their work, they will need a lot of money. Also, using media and communication in order to make your work popular may be a hard job. But most sell their rights to companies which promote their works and they win money through a system called royalties.<\/p>\n

The WIPO (World Intellectual Property Organization) states that these companies receive rights only fifty years after the death of the creator, but in some cases the national law can extend the time limit. This helps the creators and their heirs to obtain profit for some time. This treaty also includes moral rights, like the right of claiming authorship or protecting their reputation if changes are made that may harm it.<\/p>\n

Each country has its own national legislation, which gives the copyright and other rights to people. International treaties may have some of the national laws applied to make sure that there is no discrimination when granting rights to the creators. If you need more information about this, you should check the National Copyright Administration or CLEA (Collection of Laws For Electronic Access).<\/p>\n

The organization named WIPO has administrated many laws and treaties which have connection with the intellectual property rights, government assistance, and any type of requests. They also give advice to people or different non governmental organizations. However, you should consult a copyright lawyer if you want more information.<\/p>\n

Copyright is not something new. Even before any legal procedures towards copyright were done, there was copyright. People had copyright on their works although they made no formalities. This fact was stated in the Berne Convention and is available now in countries where this convention is recognized and used.<\/p>\n

WIPO has no system for copyright registration; this can be done in copyright offices in each country. Every country has laws which protect artistic works. Copyright is useful when making a difference between two works, or it may be used in courts when copyright disputes happen.<\/p>\n

Trademarks are words, names and symbols that are used as a signature for a company or business in order to make sure that people recognize their products. The brand name is the one who defines a trademark.<\/p>\n

Registration of a trademark is not required by the government. However, several advantages can be given if a trademark obtained federal registration. It includes evidences of trademark’s ownership, nationwide constructive notice about the owner<\/a>‘s claim, federal courts jurisdiction can be invoked, registration can be a basis to obtain international trademark registration, and registration can be filed with the customs service of the U.S. to prevent infringing of imported goods. Understanding the distinction between a copyright and trademark is necessary. It really helps.<\/p>\n
