The Importance Of Having A Patent Attorney

by Rex Stevenson

Every form of originality needs a signature: patent, copyright, trademark, etc. All these guarantee that a certain object or idea is unique. There are certain laws which protect inventors. Patent lawyers are specialized on matters concerning intellectual property and make sure that nobody violates the owner‘s rights. They also help during a process with all the documents and advise the inventors.

A patent attorney has much knowledge about the technology or science and has taken the exam given by the PTO, which authorizes them to handle legal matters concerning patent law. Of course the patent lawyer needs to have a law degree before taking the PTO exam, to be able to help with all the procedures which involve rights given by the law.

Besides patent attorneys people can also choose a patent agent. Patent agents can be found at the U.S. Patent and Trademark Office. There is no difference between a patent lawyer and a patent agent, as long as the patent agent has obtained an official registration of their activity.

Since the United States Court of Appeals for the Federal Circuit is an ordinary legitimate forum used to report patent infringement, patent attorneys may also select to impose copyright, trademark, or patent laws in a federal court or state. A plaintiff may accept restrictive relief or financial damages from an individual who made use of a copyright, trademark, or patent in an illegal fashion, by going to any court aside from the Court of Appeals.

You can find numerous places which will give you information about patent attorney. Also the internet will help you search for the right patent attorney. If you want an attorney from the USPTO, you should check their site and browse their database for the perfect attorney.

More so, a patent attorney should of course have a law background and shall be acknowledged to the bar in single or more legal authorities. Currently, the U.S. has a duel system for patent attorneys and agents. There are roughly 22600 active patent lawyers and 7200 active agents registered to exercise legal professions before the USPTO office, thus the inventor has an important quantity of both kinds of patent practitioners to be evaluated. A major thing that an inventor should remember when choosing either a patent attorney or patent agent is to pick one entailing enough experience in the invention field. As a universal rule, the patent attorney normally has greater fees than the patent agent due to the attorney’s extra educational background.

You should only choose people who have great experience if you want to make a good patent application. You can ask other people who are in the field to recommend someone who is good. Another way is to go to the USPTO site and search for a person in their database. Keep in mind that choosing your person near your town or near the place you live is much more effective because you will be able to meet them and keep a close relationship.

Patent attorneys may conduct patent related court litigations or exercise certain services that are permitted by the local authority as practicing or performing law. For instance, a patent lawyer can make a contract recounting a patent, for example a license or an assignment, only if he resides in a state that deems contract drafting as practicing law.

Every attorney who is authorized to handle legal matters should have taken the Patent Bar Examination; this exam authorizes the patent attorney to deal with procedures that involve intellectual property and trademark laws. The patent attorney should have both technical and law college degree. The technical degree helps the attorney to achieve knowledge in order to fully understand the principles and characteristics of the inventions which are patented. Also, it is important for attorneys to gather all new information regarding their field.

If you want to protect your intellectual property and keep matters safe, be very careful when choosing the person who will handle your application.

Life Insurance: Looking At The Big Picture

by J.D Theis

There are all kinds of health insurance policies that are available today and at least one of these divisions has little to do with your health and everything to do with what happens to the financial state of your loved ones after you?ve died.

Life insurance is one of the policy types that many people don?t want to think about, but in actuality a good life insurance policy is every bit as important as a good health insurance policy for peace of mind. Whether you?re looking for an online health insurance quote that covers accidental death and dismemberment or a term that suits your present needs, you should have a professional at your side to help you through the maze of life insurance quotes that you can easily get.

Insurance Care Direct are the professionals that can help with that task. They will be able to present you with the best online health insurance quote as it pertains to life or even any other kind of health insurance, and they only have the best agents working for you.

You need to understand a bit about life insurance so that you can make an informed decision and one of the first things that you?ll need to know is that there are two different kinds of costs that can be incurred with any life insurance policy. Sorting through them can often determine which policy that you take. These are the costs associated with mortality and the costs associated with expenses.

As the name suggests, expense costs are those associated with the price of maintaining the policy itself. The mortality costs, as that name suggests, have a darker meaning as these are the costs associated with the amount of money that the company promises to pay out upon a death. It?s all about a certain amount of statistical accuracy that determines how much the policy will cost and if in fact the company will insure you.

They generally arrive at the risk factor of death for any group by lumping the individual in with their peer group of people the same age, sex, physical habits and physical makeup. The rationale behind doing things this way is simple. It?s too hard to predict what any individual might do but a group?s actions based on the above formula is much easier to predict.

LLCs As Business Entity Choices in California

by Rich Chappo

California is a high risk, high reward state for businesses. The market is potentially very profitable, but the risk of being sued for something is also high. An LLC may be the answer to the risk factor.

To the surprise of many, the LLC has not been around for all that long. The first one was created in the late 1970s in Wyoming of all places.

California was extremely slow to do so, only allowing the entity in the early 90s. Once it became apparent the entity was very popular, the state government expanded its use.

So, what exactly is a limited liability company? It is a business entity thought up in a politician’s mind. The goal was to ease the burden on small businesses, and it does just that.

Liability should be a big concern for any business owner. If you use an LLC entity, however, you are protected from personal liability for any business debts. At the same time, you do not have to deal with the paperwork of a corporation.

Taxes are the next thing any business should focus on. Corporations can be difficult because they are double taxed. A LLC, however, is taxed like a partnership. The finances pass through to your personal return.

If you can choose to have a limited liability company taxed like a partnership, why not just use a partnership? The problem is liability. The partnership provides no protection. The limited liability company does, which makes it superior.

At this point, you might think the LLC is the obvious choice if you are going to start a business. It often is, but there are a few exceptions. Here are two that come to mind.

One way to make huge money with a business is to go public like Microsoft. An LLC, however, cannot be taken public. The ownership of the entity is held as member interest, not shares.

Taxes are a killer from both a personal and business point of view. Certain LLCs can lose the benefit of being taxed as a partnership. A single owner LLC is taxed like a sole proprietor by the IRS, canceling out any tax benefits.

Another danger with the LLC is the lack of formality. This can be a good thing, but it can also lead to laziness and sloppiness by owners. You must practice good business administration to avoid this problem.

All and all, the LLC is a very good choice for many smaller businesses. In a state like California, you get the liability protection of a corporation with the tax ease of a partnership.

The Credit Bureaus – Calculating Your Credit Score

by Michael Benifez

In 1949 Diner’s Club launched the first charge-card company. According to Dove Consulting, Americans now spend more with their credit cards – over $2 trillion yearly – than they do with cash. The creditworthiness of card users is an increasingly important issue for creditors and consumers alike.

Most people know that their creditworthiness is tracked on a credit report, but few understand how scoring works. The FICO score was developed by Fair Isaac & Co. to evaluate the likelihood that consumers will pay their bills. Scores range from 300 points (highest risk) to 850 points (lowest risk). According to Equifax, one of three major credit bureaus in the United States, FICO scores are the deciding factor on more than 75% of credit applications. In 2003, nearly 50% of Americans scored between 700 and 800.

FICO scores are mathematically determined using five factors: previous credit performance, current debts, credit tenure (how long you’ve had credit), types of credit available and pursuit of new credit.

What’s on The Report and Why Should I Care?

An in-depth look at an Equifax report provides an overview of the information that can be obtained from any of the major credit reporting bureaus. An Equifax report is divided into seven sections.

The first section contains personal data such as current and previous addresses, social security number and employment history. This is crucial information for identity thieves, so protect it. Make sure it is accurate, and shred it thoroughly before discarding it.

The second section provides a summary of your credit history. It includes the number and type of accounts (both open and closed) that you hold and whether those accounts are in good standing. It also contains a record of your credit inquiries over the last year.

It may seem like the more accounts you have, the higher your credit score will be, but in this case more is not necessarily better. Many financial institutions assume that you will use all of your available credit and factor payments that would be required to service that debt. You may have a dozen cards with zero balances and have no problem making monthly $2 000 mortgage payments, but if the bank factors your ability to pay on those cards your creditworthiness is diminished.

The third section provides detailed account information. It includes the name, type, number, opening date, balance and status of every account on your record. A breakdown of each account provides payment history, date of last activity and contact information for the credit issuer. If you disagree with any of this information, challenge it. Under federal law, the agency has 30 days to respond. If your challenge is successful, offending information will be removed from your report.

The fourth section addresses inquiries into your credit history. Inquiries are classified as “hard” or “soft”. Hard inquiries are generated when you authorize companies to access your credit report. These are tracked, and a large number of them in a one-year period will negatively affect your FICO score. Soft inquiries are generated when current creditors check your status, when card issuers review your file without being solicited and when you personally check your credit. These inquiries do not impact your credit report.

The fifth section details accounts that have been turned over to credit agencies. The sixth section provides information about liens, wage garnishments or other judgments against you in federal, state or county court records.

The final section outlines how to dispute information on your credit report. Despite the claims of late-night infomercials there is little you can do about delinquent accounts and other damaging information but wait. The Federal Trade Commission says most of this information remains on your report for seven years. Bankruptcy remains for ten years and lawsuit-related information remains until the suit is settled. You don’t need such difficulties: make payments in a timely manner and address all credit issues immediately.

How That Information Impacts Your Score

The consumer credit reporting company Equifax cites late or missed payments, credit tenure and the size of account balances in relation to credit limits as major factors impacting your FICO score. You may have an excellent income and pay your cards off fully each month, but oversized balances may still negatively affect your score. In addition, if you don’t have a mortgage, car payments or other revolving debts it is unlikely that your FICO score will reach 850.

Check Your Credit

Credit reports can be obtained instantly online for less than $50. If you are contemplating a significant purchase such as property or a second home, run a credit check on yourself at least 90 days prior to your purchase. This gives you plenty of time to address any discrepancies that appear on the report.

The three major credit bureaus in the United States are Equifax, Experian and Trans Union. They operate independently, so request a report from each of them to get a complete picture of your credit history.

Conclusion

Despite advertisements that promise to repair bad credit, prevention is the best way to avoid problems. If it is accurate, there is little you can do to clear negative information from your report but wait 7-10 years. Prevent damaging information from getting onto your credit report in the first place and improve your chance of obtaining future financing by making payments on time and addressing all issues that arise with creditors.

Where did the Cash Register come From?

by Amy Nutt

The cash register is a very important part of how commercial transactions have been done since 1879 when James Ritty invented the Ritty model after the Civil War. He owned a saloon in Dayton, Ohio and needed to find a way to keep his employees from stealing money from him. They were dipping out of the profits and he was not able to figure out who was doing it and exactly how much they were taking, but he knew it was happening.

Ritty was inspired by seeing a tool that counted propeller revolutions on a steamship, so with the help of John Birch in 1883, he was able to patent his Ritty Model. This was a great benefit to the commercial world because he was definitely not the only one encountering problems with employees pilfering profits within businesses. But Ritty became quite overwhelmed with running his cash register business and his saloon, so he sold all of the interest in his cash register business to a Cincinnati man by the name of Jacob H. Eckert. Eckert was a salesman who sold china and glassware and had created the National Manufacturing Company. Eckert then sold the National Manufacturing Company in 1884 to John H. Patterson. Patterson then renamed the company the National Cash Register Company.

Patterson went on to improve the functionality of the cash register by adding a roll of paper that transactions could be printed on. This is how the receipt was created and many transaction disputes come to an end. No longer were transaction issues a word game, but there was a piece of paper to prove it. However in 1906, the cash register was improved even more when a man named Charles F. Kettering, an employee for the National Cash Register Company, created a cash register that contained an electric motor.

All the way up until 1915, the cash register had found a home in virtually every retail store. The millionth register sold in 1911 and shopkeepers were able to keep track of their profits and their losses and keep their inventory in check. This made businesses even more competitive because they had actual numbers to go on. If there was a loss, then the shopkeeper would find a way to improve upon that loss.

The National Cash Register Company found so much success because in the 1880s and 1890s, Patterson found a way to sue all of the companies trying to compete with them in cash register sales. Some of these businesses were purchased by the National Cash Register Company and others were just put out of business all together. This was before antitrust laws existed, but in 1912 Patterson was charged with criminal conspiracy under the new Sherman Antitrust Law. The National Cash Register Company accounted for 95% of all cash register sales at that time. However, the National Cash Register Company remained the top seller of cash registers with 5900 employees on the payroll. It was in 1924 that they sold their two millionth machine.

Cash registers today

Since then, cash registers have touch screens and use the latest technology to compute transactions involving cash, checks, and credit cards. Some even have room to store counterfeit detectors on the shelf. We see different variations of them in our grocery stores, department stores, and mom and pop stores. However, there is an initial on most of these cash registers that just might look familiar and that is the letters NCR, which stands for the National Cash Register Company. They certainly saw their ups and downs from being at the top of their game in 1957 in the computer market to their buyout by AT&T in 1991, but they gained their independence and once again began developing many of the state-of-the-art cash registers we see today.

Buying a Hard Drive at an Affordable Price

by Computer Geek

It’s known that your computer needs a hard drive. If you’re looking to purchase a new computer or maybe upgrade an existing one, the hard drive is an important aspect to keep in mind. Maybe you need to replace a hard drive and don’t have a lot of money to spend. The good news is there are a lot of affordable hard drives you can choose from and you don’t have to spend a lot of money.

When you’re looking for an affordable hard drive, you should first think about the storage you want in your hard drive. To stay affordable, you should find the lowest capacity hard drive that will work for you. The larger capacity hard drives are more popular these days but they’re the ones that will cost you an arm and a leg when replacing or buying a new one. A hard drive that holds 250GB of data will surely be more affordable than one that holds 500GB.

While you’re looking for a hard drive, look also for the USB capability. A nice feature hard drives can come with now is connecting it via your USB port so it’s easier to transport between computers if you need to. This is more convenient than your standard hard drive that’s housed in your computer and isn’t transportable. A hard drive that connects via a USB port is no more expensive than your standard hard drive. The only difference in cost would of course be the storage capacity.

The lower cost hard drives will still have great transfer rates. The inner zone transfer rate will be about 50MB to up to 100MB per second on the outer zone.

You can find affordable hard drives in many different places. One such place is your local computer hardware store. They should have many hard drives for sale at different price levels. It should be pretty easy to find the right one for you.

You may also find refurbished models in your local computer hardware store. What’s different about refurbished compared to a new hard drive is that the refurbished models have previously been used. Don’t worry though, the refurbished hard drives have been cleaned and restored so it’s just like buying a new one but at a smaller price.

Also look for outlet stores in your area. Outlet stores will have great priced hard drives and the reason for the great prices is because there’s no middle man to deal with. The stores then just pass the savings on to you. You can look in your local phone book to find an outlet store near you.

The Internet is also a great place to find affordable hard drives. Two websites I recommend that sell affordable hard drives is TigerDirect.com and Superwarehouse.com. You’ll find affordable prices and many to choose from. These are reputable sites to shop for computer hardware. Make sure to only shop at reputable sites to avoid sites that aren’t protected and secure.

A hard drive is an important component for your computer. When replacing or upgrading your hard drive, finding an affordable option beats spending money you don’t have to.

Question Framing

by Kenrick Cleveland

Here’s an interesting exercise which I’m sure you’ll get real quick because you’re all such intelligent folks out there. Spell the word ‘folk’ three times. Do it right now in your mind. Spell the word ‘folk’ three times as fast as you can.

Now what do you call the white part of an egg?

What was your answer? Did you say yolk? Really?

Are you asking your prospects the right questions to get to their deepest values and criteria? When we elicit criteria, if we’re doing it right, our prospects don’t understand what they are really giving us.

So how do we make the most of our questions? What needs to be remembered is that the questions we ask cause the answer. As we learn persuasion, we learn how to better ask questions.

If I were an adviser and I sat down with a brand new client who has never bought anything from me before would I be crazy enough to ask my prospect, “Would you just tell me the two or three things that you need to hear me say today to make you buy? Just tell me so that we can get this part out of the way. Go ahead. I’m listening.”

It’s absurd. No one would give me that kind of information if I asked it in that way. It’s too blatant. They might ask you to leave nicely or they’d just laugh at you and walk away. However, when we elicit criteria they easily hand it over just like taking candy from a baby. Why one way and not the other? To an extent it’s disguised.

Your prospect doesn’t understand what they are giving you when you ask this way. Only once in a blue moon will you find someone who gives you resistance to this, but it doesn’t happen often. Even if they did understand what they were giving us, it’s absolutely acceptable to find out what your prospect needs prior to recommending a product or service. Doctors don’t just pass out medicine prior to finding out why you’re there to see them. Neither do consultants, lawyers, or sales people. We simply cannot give people any recommendation if we don’t know what they want or need.

Here’s the point and this is important: we’re setting people’s minds up so that we can enter them and we can get them to do what we want them to do. We can set them going along a direction that when we interrupt that direction, we can cause them to immediately, as if it was always so, go along with what we’re saying. (What’s the white part of an egg called?)

When I ask you ‘what’s important about X?’ or ‘if I were a magician and I had a magic wand and I could wave it and get you anything in business you want, what would it be?’ I’m listening very intently for where you have the strongest emotional reaction to one of the words that you’re saying.

We’re opening the people’s minds. We’re opening them to their own desires, to their own things.

Which Type of Real Estate Investing Is Right for You?

by Alexandria P. Anderson

Everyone knows that investing in property is a lucrative opportunity for enterprising people to make money. The advantages of entering the real estate business include paying less taxes and being able to make more money without actually lifting a finger. The prospect of putting your money to work while you sit back and relax is certainly a tempting one, and this is why so many seek a piece of the action.

Property investing success doesn’t happen by accident, though; you first need to know the nature of the business. And what is real estate, anyways? Read on to gain a better understanding of real estate, and the different ways in which you can invest.

Well, real estate is made up of parcels of land, and includes any structures built on said land. The prices you will pay for pieces of real estate are largely dependent on how the local market is faring. As an investor in real estate, you will find ample opportunities to pay less in taxes than others would. In regard to exactly what type of investing you will do, you have quite a few options.

Real Estate Investment Trusts (REITs) allow you to make money by investing in real estate, either by owning the properties themselves or by owning the mortgages on them, or to do a combination of both. The benefits of this type of investing are high yields and tax considerations. This is also a highly liquid type of investing, which means that it is easily converted to cash.

A partnership in real estate is just what it sounds like; investors may elect to partner with other people or organizations in building new structures, or making money off extant ones. Appreciation is another great source of profit for property investing partnerships, even when you’re dealing with undeveloped land. Tax benefits and growth potential make forming a partnership another great option for investors

Purchasing and renting out vacation property is another option for investors. A vacation property is distinguished from a primary residence in that renters use it for recreation, as opposed to living in it year-round.

We’ve all had dealings with landlords at one point or another in our lives, and potential real estate investors have the opportunity to become landlords by purchasing rental properties. Nothing too complicated here, but be aware that there are some differences in renting space to businesses and renting out residences.

You may also invest in raw, or undeveloped, land.

Learning about each type of investing out there is a great idea, since it is up to you to determine which path will be the most advantageous for you personally, in light of your personal strengths and talents, in addition to what you want to gain. Whichever way you go, though, the decision to invest is a good one; as well as compounding your wealth, it keeps more of the money that would have gone to taxes in your pocket.

If you are particularly interested in pursuing real estate investment because of tax benefits, you may even wish to become a real estate professional, as the IRS allows people who spend at least 750 hours a year on their investing duties to have nearly unlimited tax deductions. If you are not considered a professional, and your salary is high, that can actually cost you deductions on your real estate. You must have the time to participate in your real estate activities yourself, even if you have hired another real estate professional, to qualify for all tax benefits.

Know What Surgeon Do For You

by Salvador Paez

The Job of a Good Surgeon

Doctors known as surgeons are those types of physicians who cut open, examine or treat the internal organs and parts of a patient in order for them to get better. They dedicate themselves to some of the most technical kinds of treatment and are usually called upon when other kinds of treatment are not working.

Why do people need surgeons? There are illnesses and disorders humans acquire, where most of these are caused by some physical alterations in the body. Physical alterations that bring harm and danger to human life can’t be easily healed by just taking medicines. This is where surgeons come in. Surgeons get to work by opening the body and making the necessary treatments.

What a Surgeon Does To You

The primary job of surgeons is to perform operations that are geared towards removing unnecessary, harmful or foreign objects from your body. These can cause complications to your health and are thus have to be removed. If they don’t remove something they may be opening your body to install something that improves your health and well-being.

In this example, a surgeon can remove a failing kidney, which jeopardizes your health. Afterwards a surgeon can replace the organ he removed with a new one, so you can function normally and get on the road to recovery.

Surgeons have a variety of instruments at their disposal that can cut or hold body parts. These instruments can be similar to scissors or clips and others may be unlike anything you’ve seen but they are all geared towards a certain goal or outcome.

More Than the Diploma

Hands are some of the most important instruments in a surgeon’s arsenal aside from brains and eyes. Stability and firmness are keys to a surgeon’s success because they determine the precision of an operation, where there is no room for clumsy errors.

Grey’s Anatomy and House are just a few of the many shows on television that showcase the daily travails of surgeons. The characters do amazing things with their scalpels and brains. These shows give a lot insight into the life of surgeons and the life you may lead if you decide to be or see one.
